Terms of Service

PostSprout helps users research, generate, manage, and publish blog content, including articles, metadata, images, prompts, product references, and related marketing materials. Features may include integrations with WordPress, Shopify, AI providers, payment processors, and other third-party services.

We may modify, suspend, or discontinue parts of the Service at any time. We may also release beta or experimental features that may change or stop working without notice.

You must provide accurate account information and keep it up to date. You are responsible for safeguarding your login credentials and for all activity under your account. You must promptly notify us of unauthorized access or security issues.

You may not use the Service if you are under 13 years old or if applicable law prohibits you from using it.

"Customer Content" means content, data, prompts, images, product information, credentials, settings, and other materials you submit to or generate through the Service. You retain ownership of your Customer Content, subject to the rights granted in these Terms.

You grant PostSprout a non-exclusive, worldwide license to host, process, transmit, display, modify, and use Customer Content as needed to provide, secure, support, and improve the Service.

You represent that you have all rights, permissions, and consents needed for Customer Content and for any websites, stores, accounts, images, products, trademarks, or third-party services you connect to PostSprout.

The Service may generate content using artificial intelligence. AI-generated output may be inaccurate, incomplete, duplicative, offensive, or unsuitable for your business or audience. You are responsible for reviewing, editing, approving, and using generated output.

We do not guarantee search rankings, traffic, revenue, legal compliance of generated content, factual accuracy, or that AI-generated output will be unique. You are responsible for ensuring published content complies with applicable laws, platform rules, advertising rules, intellectual property rights, and your own editorial standards.

The Service may connect to third-party services such as Google Sheets, WordPress, Shopify, Stripe, Supabase, AI providers, and email services. Your use of third-party services is governed by their own terms and policies. We are not responsible for third-party services, outages, data practices, API changes, or content moderation decisions.

You authorize PostSprout to access, process, and transmit data to and from connected third-party services as needed to provide the Service.

Paid plans, trials, subscriptions, usage charges, renewals, cancellations, and refunds are described at checkout or in the applicable app marketplace. Unless otherwise stated, fees are non-refundable except where required by law.

If you purchase through Apple, Shopify, Stripe, or another third-party payment provider, billing and cancellation may be handled by that provider and subject to its additional terms.

You may not use the Service to violate laws, infringe intellectual property or privacy rights, send spam, publish deceptive or harmful content, bypass security controls, scrape or overload the Service, reverse engineer the Service, misuse connected platforms, or interfere with other users.

You may not submit sensitive personal information, payment card data, health information, government identifiers, or other regulated data unless the Service expressly supports that use and you have a written agreement with us permitting it.

If you access or purchase the Service through Apple, Shopify, or another app store or platform, your use may also be subject to that platform's terms. Platform providers are not responsible for the Service, support, claims, or maintenance unless their terms say otherwise.

PostSprout and its software, designs, workflows, documentation, trademarks, and other materials are owned by PostSprout or its licensors. Except for the rights expressly granted to you, we reserve all rights in the Service.

You may provide feedback, suggestions, or ideas. We may use them without restriction or compensation to you.

We may suspend or terminate access to the Service if you violate these Terms, create risk for the Service or other users, fail to pay fees, misuse integrations, or if required by law or platform rules. You may stop using the Service at any time.

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted or error-free operation.

To the maximum extent permitted by law, PostSprout will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, search ranking changes, or content performance. Our total liability for claims relating to the Service will not exceed the amount you paid to PostSprout for the Service in the three months before the event giving rise to the claim.

You will defend, indemnify, and hold harmless PostSprout from claims, damages, liabilities, losses, and expenses arising from your Customer Content, your use of the Service, your connected websites or third-party accounts, your violation of these Terms, or your violation of law or third-party rights.

Unless a separate written agreement says otherwise, these Terms are governed by the laws of the jurisdiction where PostSprout's operating entity is organized, without regard to conflict-of-law rules.

We may update these Terms from time to time. If changes are material, we will provide notice as appropriate. Your continued use of the Service after changes become effective means you accept the updated Terms.
